The Occupational Safety and Health Administration reports that about 4,836 workers died on the job in 2015. This translates to an average of more than 93 deaths a week and 13 deaths per day. The Illinois Workers’ Compensation Commission (IWCC) is the government agency in charge of handling workers’ compensation claims between employees and employers. The IWCC is an impartial court that reviews the claims. If the claim is accepted, the worker is entitled to receive benefits.
In Illinois, an injured worker is entitled to payment of “reasonable” and “necessary” medical care, subject to the limits set forth in the Illinois Medical Fee Schedule. This typically includes compensation for expenses such as medical care, surgery, hospital care, devices such as a life or wheelchair and physical therapy. Workers can also seek reimbursement for any out of pocket expenses (i.e., medication) that may be necessary to treat the injury.
If a worker is unable work due to a work-related injury, that employee may be entitled to a portion of his or her wages for a certain amount of time. When a worker is off work to heal from an injury, that employee will be entitled to receive Temporary Total Disability (TTD) benefits, typically two third of his or her weekly wages. When a worker is able to work but is on “light duty” while healing from the injury, that employee will be entitled to Temporary Partial Disability (TPD) benefits. When a worker is permanently disabled or disfigured, but can work, that person will be entitled to Permanent Partial Disability (PPD) benefits. A worker who is permanently unable to work will be entitled to Permanent Total Disability (TPD) benefits.
