Definition
A catastrophic injury
or illness happens suddenly and without warning.  Personal injury cases that are defined as any serious injury that result in permanent disability, long-term medical problems or shortened life expectancy are considered a catastrophic injury.   The scope of catastrophic injuries varies and can include (but is not limited to) the following:

  • spinal cord injury
  • brain injury
  • paralysis
  • amputations
  • burns and blindness

The Law
A catastrophic injury that has been caused by the intentional or negligent act of another or by a dangerous or defective product should be claimed by the victim immediately.  Claiming a catastrophic injury is a vital factor in determining his or her future quality of life, including the quality of the medical care and other support he or she will receive.   One of the most important aspects of claiming a catastrophic injury is determining the value of such a claim because of the immense financial implications.

The long-term implications of many catastrophic injuries often do not surface or become apparent until years after the original injury.  For example, individuals that are injured during their adolescent stage may find developmental disabilities as they progress into their later years in life, requiring medical procedures such as surgeries that may accommodate their growth.

Compensation
An attorney must then understand the long-term effects of a catastrophic injury and ensure sufficient and just compensation for the well deserved victim and their family.
